Many business owners do not have a will. Of those that do, the majority are standard
‘simple’ wills. All business owners should have business-person wills. The reason
for this is:
- Your executors need the appropriate powers to chase up your creditors, and collect
payment from them;
- Your executors need the authority to continue the business until the market is right
to sell it; without this authority the business must be sold within 12 months of
your death - even if the market conditions [for sale] are atrocious.
- The only option is for your business to be sold, unless you have made a will. If
you have made your will then you can give away your business to a family member,
or allow your family to continue the business.
