Is your Last Will and Testament legal? It might surprise you but many wills are not legal; they have not been made in compliance of the strict criteria set out in the  Wills Act 1837.

Many more wills are legal, but because they were made using an online will-writer, or over the phone, or by postal application, or using a DIY kit, these wills are vulnerable.  They are vulnerable to accusations of undue influence, lack of mental capacity, and/or fraud -- the accusations are usually made after the testator’s death.  And proving your will was not subject to these accusations can be very difficult  -- especially if you have already died!

Yet more wills are simply out of date.  Out of date because the testator’s circumstances have changed, or their family’s circumstances have, or the taxation rules have changed -- and the testator has just never found the time to update their will.
