Many of the family problems can be overcome where the deceased made an effective will. But many existing wills are defective; the defect will only come to light after the testator’s death unless action is taken in the interim.

An illegal will: i.e. The document was not made in accordance with the Wills Act 1837.
No professional defence: A professional will drafter should keep records of the meetings they had with their clients. These notes should show the client’s state of mind, who else was present when the instructions were being given, and more.
